1. Purpose
These Terms of Sale (hereinafter the "Terms of Sale") define the terms and conditions for subscribing to the paid services offered by FittingMe.AI (hereinafter the "Premium Services"), accessible via the FittingMe.AI mobile application (hereinafter the "Application").
These Terms of Sale supplement the Terms of Use of the Service. In the event of a conflict between the Terms of Use and the Terms of Sale, the provisions of these Terms of Sale shall prevail with respect to the Premium Services.
Any subscription to a Premium Service implies the unreserved acceptance of these Terms of Sale by the User.
2. Definitions
Terms defined in the Terms of Use retain the same meaning in these Terms of Sale. In addition:
- "Subscription": the subscription agreement for a Premium Service, entered into for a fixed, renewable term.
- "Billing Period": the period for which the Subscription is taken out (monthly or annual).
- "Premium Services": the advanced features and/or higher usage quotas offered for payment, as described in Article 4.
- "Seller": FittingMe.AI SAS, a simplified joint-stock company (société par actions simplifiée) in the process of registration, with its registered office at [To be completed], registered with the RCS of [To be completed] under number [To be completed]. Intra-community VAT number: [To be completed].
3. Scope of Application
3.1. Applicable Users
These Terms of Sale apply to any User, a natural person acting in a personal capacity (consumer within the meaning of the preliminary article of the French Consumer Code), subscribing to a Premium Service Subscription via the Application.
3.2. Territory
Premium Services are offered to Users residing in the European Union.
4. Description of Premium Services
Premium Services include, depending on the chosen plan:
4.1. Increased Usage Quotas
- Increased or unlimited number of virtual try-ons per day;
- Increased or unlimited number of garment analyses per day;
- Increased number of collections and outfits.
4.2. Advanced Features
- Priority access to new features;
- Enhanced image resolution for virtual try-ons;
- Advanced clothing suggestions;
- Any other feature identified as "Premium" in the Application.
Details of the features and quotas included in each Subscription plan are available in the Application, on the Premium Services subscription page. FittingMe.AI reserves the right to modify the content of Subscription plans, subject to informing the User in accordance with Article 10.
5. Prices
5.1. Pricing
Premium Services prices are displayed in euros, including all taxes (TTC — toutes taxes comprises), on the Application's subscription page. They include VAT at the rate in effect on the date of subscription.
5.2. Price Changes
FittingMe.AI reserves the right to change its prices at any time. Price changes shall apply:
- immediately to new subscriptions;
- from the next renewal for current Subscriptions, provided the User has been informed of the change at least thirty (30) days before the renewal date.
In the event of a price change, the User may cancel their Subscription before the renewal date in accordance with Article 8.
6. Payment Methods
6.1. Payment Means
Payment for Premium Services is made via the payment platforms integrated into the application stores:
- Apple App Store (Apple In-App Purchase) for iOS devices;
- Google Play Store (Google Play Billing) for Android devices.
Accepted payment methods are those offered by the relevant platform (bank card, store account credit, etc.).
6.2. Billing
Payment is due at the time of subscription, then on each Subscription renewal date. Payment is automatically debited by the payment platform.
6.3. Invoices
A payment confirmation is issued by the payment platform (Apple or Google). The User may obtain a detailed invoice upon request by contacting contact@fittingme.ai.
7. Right of Withdrawal
7.1. Principle
In accordance with Articles L.221-18 et seq. of the French Consumer Code, the User, in their capacity as a consumer, has a right of withdrawal of fourteen (14) days from the date of Subscription, without having to justify reasons or incur penalties.
7.2. Waiver of the Right of Withdrawal
In accordance with Article L.221-28, 13° of the French Consumer Code, a User who begins using the Premium Services before the expiration of the withdrawal period may be asked to expressly waive their right of withdrawal. In this case, the User will be clearly informed before subscribing and must give their express consent.
In the absence of an express waiver, the right of withdrawal is exercised under the conditions described below.
7.3. Exercising the Right of Withdrawal
To exercise their right of withdrawal, the User must notify their decision to withdraw by means of an unambiguous statement:
- By email: contact@fittingme.ai — subject: "Exercise of Right of Withdrawal"
- By postal mail: FittingMe.AI SAS, [registered office address — to be completed]
The User may use the standard withdrawal form in Appendix A of these Terms of Sale, although this is not mandatory.
7.4. Refund
In the event of exercise of the right of withdrawal, FittingMe.AI will refund all sums paid, without undue delay, and no later than fourteen (14) days from the receipt of the withdrawal notification.
The refund will be made using the same payment method as that used for the initial transaction, unless the User expressly agrees to a different method. If payment was made via a third-party platform (Apple, Google), the refund will be processed in accordance with the policies of said platform.
7.5. Effects of Withdrawal
In the event of withdrawal, access to the Premium Services will be immediately deactivated and the User will revert to the features of the free version of the Service.
8. Duration and Renewal
8.1. Subscription Duration
The Subscription is taken out for a fixed Billing Period (monthly or annual), chosen by the User at the time of subscription.
8.2. Automatic Renewal
Unless cancelled by the User, the Subscription is automatically renewed for a Billing Period identical to the initial period, at the prices in effect at the time of renewal (subject to the prior notice provided in Article 5.2).
In accordance with Article L.215-1 of the French Consumer Code, the User is informed, no earlier than three months and no later than one month before the renewal date, of the possibility of not renewing their Subscription.
8.3. Cancellation by the User
The User may cancel their Subscription at any time via:
- the Application settings;
- the subscription settings of the relevant platform (App Store or Google Play Store).
Cancellation takes effect at the end of the current Billing Period. The User retains access to the Premium Services until the end of the paid period. No pro-rata refund is due for the remaining period, except in the case of exercise of the right of withdrawal under the conditions of Article 7.
8.4. Termination by FittingMe.AI
FittingMe.AI may terminate the Subscription in the cases provided for in Article 15.2 of the Terms of Use (violation of the Terms of Use, fraud, breach of security). In the event of termination for User breach, no refund is due.
9. Warranties
9.1. Legal Warranty of Conformity
In accordance with Articles L.224-25-12 et seq. of the French Consumer Code, the User benefits from the legal warranty of conformity for digital content and services. This warranty covers defects in conformity existing at the time of delivery of the digital content and those appearing within two (2) years of delivery.
In the event of a defect in conformity, the User may require the Premium Service to be brought into conformity, or, if this is impossible or entails disproportionate costs, obtain a price reduction or contract termination in accordance with the applicable legal provisions.
9.2. Warranty Against Hidden Defects
In accordance with Articles 1641 et seq. of the French Civil Code, the User benefits from the legal warranty against hidden defects. If a hidden defect renders the Premium Service unfit for its intended use or diminishes such use to the extent that the User would not have subscribed or would have paid a lower price had they known of it, the User may obtain a refund or a price reduction, in accordance with the applicable legal provisions.
9.3. Information Notice (Art. L.211-2 French Consumer Code)
The consumer has a period of two years from the delivery of the digital content or digital service to enforce the legal warranty of conformity in the event of a defect in conformity. During a period of one year from delivery, the consumer is only required to establish the existence of the defect in conformity and not its date of appearance.
The legal warranty of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the digital content or digital service.
The legal warranty of conformity entitles the consumer to the conformity of the digital content or digital service without undue delay following their request, at no cost and without major inconvenience to them.
The consumer may obtain a price reduction while retaining the digital content or digital service, or may terminate the contract by obtaining a full refund in exchange for relinquishing the digital content or digital service, if: 1. The professional refuses to bring the digital content or digital service into conformity; 2. The conformity of the digital content or digital service is unjustifiably delayed; 3. The conformity of the digital content or digital service cannot be achieved without cost to the consumer; 4. The conformity of the digital content or digital service causes major inconvenience to the consumer; 5. The defect in conformity of the digital content or digital service persists despite the professional's unsuccessful attempt at conformity.
The consumer is also entitled to a price reduction or contract termination when the defect in conformity is so serious as to justify an immediate price reduction or contract termination. The consumer is not required to request conformity of the digital content or digital service beforehand.
In cases where the defect in conformity is minor, the consumer is only entitled to contract termination if the contract does not provide for payment of a price.
10. Changes to these Terms of Sale
FittingMe.AI reserves the right to modify these Terms of Sale at any time. Modifications will take effect for new subscriptions upon publication in the Application.
For current Subscriptions, any material modification will be notified to the User at least thirty (30) days before its effective date. A User who does not accept the modifications may cancel their Subscription before the effective date, in accordance with Article 8.3.
11. Consumer Mediation
In accordance with Articles L.611-1 et seq. and R.612-1 et seq. of the French Consumer Code, in the event of a dispute not resolved by FittingMe.AI's customer service, the User may free of charge resort to the following mediation service:

The User may also use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
In accordance with Article L.612-2 of the French Consumer Code, the User may only refer the matter to the mediator after having previously attempted to resolve the dispute directly with FittingMe.AI by means of a written claim sent to contact@fittingme.ai.
12. Liability
The liability provisions set out in Article 12 of the Terms of Use apply to the Premium Services. In addition:
- FittingMe.AI does not warrant that the Premium Services will meet all of the User's expectations;
- Premium Services are provided subject to the availability of the third-party artificial intelligence systems on which the Service depends;
- in the event of prolonged unavailability of the Premium Services (exceeding 72 consecutive hours) not attributable to a force majeure event, the User may obtain a pro-rata credit for the duration of the unavailability upon request sent to contact@fittingme.ai.
13. Governing Law
These Terms of Sale are governed by French law.
14. Jurisdiction
In the event of a dispute relating to the interpretation, performance, or termination of these Terms of Sale, and failing amicable resolution or mediation, the provisions of Article 17 of the Terms of Use regarding competent jurisdiction shall apply.
15. Miscellaneous Provisions
15.1. Severability
If any provision of these Terms of Sale is declared null or unenforceable, the remaining provisions shall remain in full force and effect.
15.2. Entire Agreement
These Terms of Sale, together with the Terms of Use, the Privacy Policy, and the other contractual documents referenced, constitute the entire agreement between the parties regarding the Premium Services.
