1. Purpose

These Terms of Use (hereinafter the "Terms") define the terms and conditions of access to and use of the FittingMe.AI service (hereinafter the "Service"), accessible via the FittingMe.AI mobile application (hereinafter the "Application").

By accessing the Service or creating an account, the User acknowledges having read these Terms and accepts them without reservation. If the User does not accept these Terms, they must refrain from using the Service.

2. Definitions

In these Terms, the following terms, when used with an initial capital letter, have the following meaning:

  • "Application": the FittingMe.AI mobile application, available on iOS and Android platforms.
  • "User Content": any content uploaded by the User via the Service, including photographs (face, body, garments), data entered, and associated metadata.
  • "Generated Content": any content produced by the Service's artificial intelligence systems from User Content, including virtual try-on images, virtual body models, extracted attributes, and clothing suggestions.
  • "Publisher" or "We": FittingMe.AI SAS, a simplified joint-stock company (société par actions simplifiée) in the process of registration, with its registered office at [To be completed], registered with the RCS of [To be completed] under number [To be completed].
  • "Service": all features offered by FittingMe.AI via the Application, including the virtual fitting room, wardrobe management, clothing suggestions, and related features.
  • "User" or "You": any natural person who accesses the Service and/or creates an account on the Application.

3. Description of the Service

FittingMe.AI is a virtual fitting room service that allows the User to:

  1. Create a virtual body model: by taking photos of their face and body, the User obtains a personalized virtual representation generated by artificial intelligence.
  2. Manage a virtual wardrobe: import garments from their physical wardrobe (by photographing them) or from online stores, organize and categorize them.
  3. Virtually try on garments: visualize how garments look on their virtual body model through AI-generated images.
  4. Receive clothing suggestions: get outfit recommendations adapted to the weather, personal style, and the User's wardrobe.
  5. Organize and share outfits: create outfit collections and share them.

The Service uses artificial intelligence systems. Virtual try-on images are synthetic images generated by AI and are not real photographs. Clothing suggestions are automatically generated and do not constitute professional advice. For more information, the User may consult the AI Transparency Notice.

4. Access Conditions

4.1. General Conditions

Access to the Service requires:

  • a compatible mobile device (iOS or Android);
  • an Internet connection;
  • the creation of a user account.

4.2. Age Requirements

In accordance with Article 45 of French Law No. 78-17 of January 6, 1978, as amended:

  • Under 13: the use of the Service is strictly prohibited. FittingMe.AI implements an age verification mechanism during registration.
  • 13 and 14: the use of the Service is subject to obtaining verifiable consent from a holder of parental authority.
  • 15 and over: the User may access the Service and autonomously consent to the processing of their personal data.

4.3. Availability

FittingMe.AI endeavors to ensure the availability of the Service 24 hours a day, 7 days a week. However, access to the Service may be interrupted, particularly for maintenance operations, updates, or in the event of force majeure. FittingMe.AI does not guarantee uninterrupted access and shall not be held liable for any interruptions to the Service.

5. Account Creation

5.1. Registration

Account creation is performed via the Google Sign-In authentication mechanism (Firebase Authentication). By creating an account, the User:

  • certifies that they meet the age requirements set out in Article 4.2;
  • accepts these Terms;
  • acknowledges the Privacy Policy;
  • consents, where applicable, to data processing requiring explicit consent.

5.2. Account Security

The User is responsible for maintaining the confidentiality of their login credentials and for all activity carried out under their account. The User undertakes to immediately inform FittingMe.AI of any unauthorized use of their account.

5.3. Single Account

Each natural person may only hold one account. The creation of multiple accounts is prohibited.

6. User Obligations

The User undertakes to:

6.1. Compliance with the Law and Terms

  • use the Service in accordance with these Terms, French legislation, and applicable regulations;
  • not use the Service for unlawful, fraudulent purposes, or in a manner that infringes the rights of third parties.

6.2. User Content

  • only upload User Content for which they hold the rights or for which they have authorization;
  • not upload unlawful, offensive, defamatory, pornographic, violent content, or content contrary to public order and morality;
  • only upload photos of themselves (unless they have the express authorization of the third party concerned);
  • not upload photos of minors unless it is the User themselves and they meet the age requirements.

6.3. Use of the Service

  • not attempt to circumvent the security measures, access restrictions, or quotas of the Service;
  • not use robots, scripts, or any other automated means to access the Service;
  • not reverse engineer, decompile, or disassemble the Application;
  • not use the Service in a manner that impairs its operation or the integrity of its systems;
  • not resell, sublicense, or commercialize access to the Service or Generated Content without prior authorization from FittingMe.AI.

6.4. Use of Generated Content

The User undertakes to:

  • not present Generated Content (virtual try-on images) as real photographs;
  • not use Generated Content for deception, identity theft, or manipulation purposes;
  • respect the rights of third parties when sharing Generated Content.

7. User Content

7.1. Ownership

The User retains all intellectual property rights in the User Content they upload via the Service (photographs of their face, body, and garments).

7.2. License Granted

By uploading User Content, the User grants FittingMe.AI a non-exclusive, worldwide, royalty-free license, for the duration of the use of the Service, solely for the following purposes:

  • technical processing necessary for the operation of the Service (storage, display, transmission to AI systems for content generation);
  • improvement of the Service (subject to prior anonymization).

This license terminates upon the deletion of the User Content by the User or the deletion of their account, subject to technical deletion delays (maximum 30 days).

7.3. Liability

The User is solely responsible for the User Content they upload. FittingMe.AI does not exercise any prior control over User Content but reserves the right to remove any manifestly unlawful content of which it becomes aware.

8. AI-Generated Content

8.1. Nature of Generated Content

Generated Content (virtual try-on images, virtual body models, extracted attributes, clothing suggestions) is automatically produced by artificial intelligence systems. It has the following characteristics:

  • It does not constitute a real photograph: try-on images are synthetic images.
  • It may contain inaccuracies: results are approximations and do not guarantee a faithful rendering of reality.
  • It does not constitute professional advice: clothing suggestions do not replace the opinion of a fashion or styling professional.

8.2. Intellectual Property of Generated Content

Subject to applicable intellectual property legislation:

  • License of use: FittingMe.AI grants the User a personal, non-exclusive, non-transferable, and revocable license to use the Generated Content for their personal and private use.
  • Restrictions: the User may not commercially exploit the Generated Content without the prior written authorization of FittingMe.AI.
  • FittingMe.AI retains all intellectual property rights in the algorithms, models, and technologies used to generate the content.

8.3. AI Marking

In accordance with Regulation (EU) 2024/1689 (AI Act), AI-generated Content is identified as such within the Application. The User undertakes to maintain this identification when sharing Generated Content outside the Application.

9. Acceptable Use

Without prejudice to the provisions of Article 6, it is strictly prohibited to use the Service to:

  • undermine human dignity;
  • create, distribute, or store content depicting minors inappropriately;
  • harass, threaten, or intimidate third parties;
  • impersonate a third party or create deepfakes;
  • violate the intellectual property rights of third parties;
  • conduct unauthorized commercial activities;
  • collect data from other users;
  • disrupt or overload the Service's systems.

In the event of a violation of this article, FittingMe.AI reserves the right to suspend or delete the User's account without notice or compensation, without prejudice to any legal action.

10. Personal Data

The processing of the User's personal data is governed by the Privacy Policy, available in the Application and constituting a separate document from these Terms.

The User is invited to consult the Privacy Policy to learn about the methods of collection, processing, retention, and protection of their personal data, as well as the rights they have in this regard.

11. Intellectual Property

11.1. Rights of FittingMe.AI

The Application, the Service, and all their components (software, databases, algorithms, AI models, interfaces, design, texts, graphics, logos, trademarks, domain names) are protected by the provisions of the French Intellectual Property Code and applicable international conventions.

Any reproduction, representation, modification, distribution, or exploitation, in whole or in part, of any of these elements, by any means and on any medium, without the prior written authorization of FittingMe.AI, is strictly prohibited and constitutes an act of infringement within the meaning of Articles L.335-2 et seq. of the French Intellectual Property Code.

11.2. Trademarks

"FittingMe.AI" and the associated logo are trademarks of FittingMe.AI SAS [registration pending / registered]. Any reproduction or use of these trademarks without authorization is prohibited.

11.3. Application License

FittingMe.AI grants the User a personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Application, for strictly personal and non-commercial use, for the duration of the User's registration with the Service.

12. Liability and Warranties

12.1. Service Provided "As Is"

The Service is provided "as is" and "as available." FittingMe.AI does not warrant that:

  • the Service will be free from errors, bugs, or interruptions;
  • the results obtained via the Service (virtual try-ons, suggestions) will be accurate, complete, or meet the User's expectations;
  • the Service will be compatible with all devices and configurations.

12.2. Limitation of Liability

To the extent permitted by applicable law and without prejudice to consumer rights:

  • FittingMe.AI shall not be liable for indirect damages (data loss, loss of opportunity, reputational damage, commercial loss) resulting from the use or inability to use the Service;
  • FittingMe.AI's total liability under these Terms shall not exceed the total amount actually paid by the User during the twelve (12) months preceding the event giving rise to liability;
  • FittingMe.AI is not responsible for the content of third-party websites to which the Application may link.

12.3. Force Majeure

FittingMe.AI shall not be held liable for the total or partial non-performance of its obligations if such non-performance is due to an event of force majeure within the meaning of Article 1218 of the French Civil Code.

12.4. User Responsibilities

The User acknowledges that:

  • virtual try-on images are AI-generated images and do not constitute a faithful representation of reality;
  • they are solely responsible for decisions (particularly purchasing decisions) made based on the results provided by the Service;
  • they assume full responsibility for their use of the Service and the Generated Content.

13. Premium Services

13.1. Freemium Model

The Service is offered on a freemium model:

  • Free version: access to basic features with limited usage quotas (number of virtual try-ons, number of garment analyses per day).
  • Premium version: access to advanced features and/or higher quotas, subject to payment of a subscription.

13.2. Terms of Sale

The conditions for accessing premium services, including prices, payment methods, and the right of withdrawal, are defined in the Terms of Sale (Conditions Générales de Vente), which constitute a separate document from these Terms.

14. Modification of the Terms

FittingMe.AI reserves the right to modify these Terms at any time. Modifications will take effect upon their publication in the Application.

In the event of a material modification, the User will be informed by notification in the Application at least thirty (30) days before the effective date of the new Terms. Continued use of the Service after the effective date of the modifications constitutes acceptance of the modified Terms.

If the User refuses the modified Terms, they must cease using the Service and delete their account before the effective date of the new Terms.

15. Termination

15.1. Termination by the User

The User may terminate their account at any time by using the account deletion feature available in the Application settings. Termination results in the deletion of all User data within 30 days, in accordance with the Privacy Policy.

15.2. Termination by FittingMe.AI

FittingMe.AI may suspend or terminate the User's account, as of right and without notice, in the following cases:

  • violation of these Terms, particularly Articles 6 and 9;
  • fraudulent use of the Service;
  • breach of the security of the Service or the rights of third parties;
  • prolonged inactivity of the account (more than 24 months without login), after 30 days' prior notification.

In the event of termination for breach, FittingMe.AI will inform the User of the reasons for termination and allow them to exercise their rights regarding their personal data.

15.3. Effects of Termination

Termination of the account, regardless of the cause, results in:

  • the cessation of the right of access to the Service;
  • the deletion of User Content and Generated Content within 30 days;
  • where applicable, the loss of the benefit of remaining premium services (subject to the right of withdrawal provided by the Terms of Sale).

16. Governing Law

These Terms are governed by French law.

In accordance with Article L.612-1 of the French Consumer Code, the User is informed that they may free of charge resort to a consumer mediator for the amicable resolution of any dispute with FittingMe.AI. The competent mediator will be designated and communicated to the User in due course.

17. Jurisdiction

In the event of a dispute relating to the interpretation, performance, or termination of these Terms, and failing amicable resolution, the competent courts of Paris shall have exclusive jurisdiction.

However, in accordance with Articles R.631-3 et seq. of the French Consumer Code, a User who qualifies as a consumer may bring proceedings, at their choice, before:

  • the court of the place where they resided at the time of the conclusion of the contract or the occurrence of the harmful event;
  • the courts of Paris.

18. Severability

If any provision of these Terms is declared null or unenforceable by a competent court, the remaining provisions shall remain in full force and effect. The null provision shall be replaced by a valid provision that most closely approximates the original intent of the parties.

19. Waiver

The failure of FittingMe.AI to exercise any right or prerogative arising from these Terms shall not be construed as a waiver of the exercise of such right or prerogative.

20. Entire Agreement

These Terms, the Privacy Policy, the Cookie Policy, the AI Transparency Notice, and, where applicable, the Terms of Sale, constitute the entire agreement between the User and FittingMe.AI regarding the use of the Service, and replace any prior agreement relating to the same subject matter.
